Scope
These Terms & Conditions govern the relationship between the student (or their legal guardian) and Linguabox OÜ, operating under the brand name Tarkiva (hereinafter referred to as the “Company”).
Course Structure
- Lessons are conducted in small groups
- Each session consists of 45 minutes + 5-minute break + 45 minutes
- Courses are organized in fixed modules
- The Company reserves the right to merge or adjust groups if necessary
Booking & Payment
- Payment is required in advance
- Booking is confirmed only after full payment
- All prices are stated in EUR
Right of Withdrawal (EU)
Consumers residing in the European Union have the right to withdraw from their purchase within 14 days without giving any reason.
By enrolling in a course and explicitly requesting that the course begins before the end of the withdrawal period, the student acknowledges that:
- If the service has already begun,
- A proportionate amount may be charged for services already provided
Cancellation & Refunds
- Payment is required in advance
- Bookings are confirmed after payment
- Missed lessons are non-refundable
- No rescheduling is provided for no-shows
If withdrawal occurs within the 14-day period after the course has started, the Company may charge for the portion already delivered.
Once a course module has been fully completed, no refunds will be issued under any circumstances.
Minimum Enrollment
The Company reserves the right to cancel or reschedule a course if the minimum number of participants is not reached.
In such cases, students will be offered:
- an alternative course, or
- a full refund
Schedule Changes
The Company reserves the right to make reasonable adjustments to course schedules where necessary.
Participation Rules
Students must:
- Join lessons on time
- Behave respectfully
- Ensure proper technical setup
The Company reserves the right to remove participants for misconduct without refund.
Technical Requirements
The Company is not responsible for issues arising from:
- the student’s internet connection
- device or hardware limitations
- software configuration problems
No refunds or rescheduling will be provided for such issues.
Teacher Changes
Teachers may be replaced if necessary.
If a lesson is cancelled due to circumstances beyond the Company’s control and no substitute teacher is available, the lesson may be rescheduled and added to the end of the course.
Independent Teachers
Teachers providing courses act as independent contractors.
The Company facilitates the platform and course structure but is not responsible for:
- individual teaching styles
- subjective learning experiences
- personal expectations of students
No Guarantee of Results
The Company does not guarantee:
- specific learning outcomes
- language proficiency improvements
- exam success
Intellectual Property
All materials provided during the course are protected by intellectual property laws and may not be:
- copied
- recorded
- shared
- distributed
without prior written permission.
Recording Policy (Company)
Lessons may be recorded for:
- quality assurance
- training purposes
- internal improvements
Recordings:
- may be anonymized
- will not be used publicly without explicit consent
Students may opt out in writing.
Prohibition of Recording by Students
Students are strictly prohibited from recording lessons in any form.
Violation may result in:
- immediate termination
- no refund
- legal action
Communication
Official communication should take place through the platform.
Use of external communication tools (e.g. WhatsApp, Telegram) is limited to logistical purposes only.
Young Learners (Under 18)
Parental Consent
Registration must be completed by a parent or legal guardian.
The parent:
- accepts all Terms
- is responsible for payment
- ensures compliance
Protection of Minors
- Recordings are handled with additional care
- No identifiable use without explicit parental consent
Responsibility
Parents remain responsible for:
- attendance
- technical setup
- supervision outside lessons
Payment Disputes
By purchasing a course, the student agrees to contact the Company first in case of any issue before initiating a chargeback or dispute with the payment provider.
Liability
The Company is liable only in cases of intent and gross negligence.
The Company shall not be held liable for:
- indirect damages
- loss of opportunity
- dissatisfaction with subjective learning outcomes
Force Majeure
The Company shall not be held liable for failure or delay in performance due to events beyond its reasonable control, including:
- internet outages
- technical failures
- platform disruptions
- third-party service failures
- force majeure events
Governing Law
This Agreement shall be governed by the laws of Estonia.
